Announcement of Amendment to iPASS Co-Branded Card Special Terms and Conditions

Dear Customers:

Thank you for your support and use of E.SUN Bank credit cards. Due to the merging of laws governing electronic stored value cards and electronic payment, the Bank’s iPASS Co-Branded Card Special Terms and Conditions shall be amended, with amendments taking effect on June 15, 2022. Please refer to the comparison table below detailing the changes to these Terms and Conditions before and after the amendment. If the cardholder has any objections to these amendments, please notify E.SUN before the date that these amendments become effective to terminate your agreement (if no notification is submitted, the cardholder shall be deemed as having agreed to these amendments).

Article 1 Terminology
Definitions for the terminology used in these Special Terms and Conditions are as follows:
I. iPASS Card: Refers to the iPASS stored-value card (hereinafter referred to as the iPASS Card) issued by iPASS Corporation. iPASS cardholders may deposit funds into the card and use these funds to pay for transportation and parking expenses, as well as other services or goods within the boundaries permitted by law. The card serves as multi-purpose payment tool.
II. iPASS Co-Branded Card: This refers to the chip cards issued by the issuing bank in collaboration with iPASS Corporation that may be used as both a credit card and an iPASS card. iPASS Co-Branded cards have the same iPASS card functions as a named iPASS Card, allowing the cardholder to suspend the card and claim refunds if the card is lost.
III. Autoload: This refers to the function allowing iPASS Co-branded Cardholders to automatically add a specified amount to their iPASS Card balance through an autoload machine when using the Co-Branded Card as an iPASS Card pursuant to the agreement between the cardholder and the issuing bank, with this amount being put on the cardholder’s credit card as a standard credit card purchase. This function may be used when the card balance is insufficient to cover an expense, or when the card balance is below some specific amount, and the automatically reloaded amount must be within the cardholder’s credit limit. The minimum card balance and autoload top-up amount shall be based on the information announced on the iPASS Corporation website (www.i-pass.com), or on the issuing bank’s website.
IV. Balance transfer: Refers to a single transfer of the entire iPASS Card balance into the cardholder’s credit card account, with the transferred balance used to directly offset the credit card bill. Any remaining balance after this offset shall be processed pursuant to the issuing bank’s overpayment rules. However, if the iPASS balance is negative, the cardholder shall agree to treat this negative balance as an ordinary credit card purchase and have it collected from the designated account.
V. Associated merchant: Refers to merchants who have entered into an agreement with iPASS Corporation, allowing the cardholder to make purchases from these merchants using their iPASS card.
VI. Special Terms and Conditions for registering named card: The cardholder agrees that the issuing bank may provide the iPASS Corporation with personal information such as their name, National ID number (Taiwan Resident Certificate Number, or some other ID method agreed to by both parties), date of birth, phone number, and address in order for the iPASS card to be approved and issued. The cardholder also agrees that the iPASS Corporation may use this personal information to facilitate the specific functions of the iPASS Co-Branded Card and to provide card-related services (such as registering a card as lost). The cardholder is entitled to exercise their rights pursuant to Article 3 of the Personal Data Protection Act. If the cardholder does not agree to allow the iPASS Corporation to use their personal information, the iPASS Co-Branded Card cannot be approved and issued, due to iPASS functions not being able to function correctly.
VII. Deferred goods or services: Refers to transactions where goods or services are delivered over a certain period of time, instead of a one-time delivery.
Article 1 Terminology
Definitions for the terminology used in these Special Terms and Conditions are as follows:
I. iPASS Co-Branded Card: This refers to the chip cards issued by E.SUN Bank in collaboration with iPASS Corporation that may be used as both a credit card and an iPASS Card. iPASS Co-Branded cards have the same iPASS Card functions as a named iPASS Standard Card, allowing the cardholder to suspend the card and claim refunds if the card is lost.
II. iPASS Card: Refers to the iPASS stored-value card (hereinafter referred to as the iPASS Card), or the electronic stored-value card referred to as “ ” issued by iPASS Corporation. iPASS cardholders may deposit funds into the card and use these funds to pay for transportation and parking expenses, as well as other services or goods within the boundaries permitted by law. The card serves as multi-purpose payment tool.
III. Autoload: This refers to the function allowing iPASS Co-branded Cardholders to automatically add a specified amount to their iPASS Card balance through autoload machines when using the Co-Branded Card as an iPASS Card, pursuant to the agreement between the cardholder and E.SUN Bank. This function may be used when the card balance is insufficient to cover an expense, or when the card balance is below some specific amount, and the automatically reloaded amount must be within the cardholder’s credit limit. The amount available for automatic reload is equal to the amount that the cardholder is able to put on their credit card (without accounting for reward points or cash-backs). Any matters not covered in these Special Terms and Conditions shall be governed by the credit card agreement.
IV. Balance transfer: Refers to a single transfer of the entire iPASS Card balance into the cardholder’s credit card account This balance is not transferred into the replacement or re-issued card (The iPASS balance of all newly-issued cards are zero). Balance transferred into the cardholder’s credit card account is used to directly offset the credit card bill, and any remaining balance after the bill has been settled will be processed pursuant to the issuing bank’s overpayment rules. However, However if the iPASS balance is negative, the cardholder shall agree to treat this negative balance as an ordinary credit card purchase and have it collected from the designated account. A balance transfer requires approximately 40 working days to be processed, and a balance transfer can only be conducted once per card. The entire balance of a card must be transferred in a balance transfer.
V. Associated merchant: Refers to a merchant that has signed a written agreement with iPASS Corporation to accept iPASS payments for goods and services made by iPASS cardholders, as well as for other transactions to a government agency or for designated transactions approved by the competent authorities.
VI. Deferred goods or services: Refers to transactions where goods or services are delivered over a certain period of time, instead of a one-time delivery.
Article 2 iPASS Card expiration date
The expiration date of the iPASS card is the same as that of the credit card. When the credit card expires, the card’s iPASS and autoload functions shall also be terminated.
Article 2 Applying for and using the iPASS Co-Branded Card
I. Application method: The applicant shall fill out all parts of the application form and submit this application to E.SUN Bank to apply for an iPASS Co-Branded Card pursuant to E.SUN Bank’s rules. The cardholder is required to agree to E.SUN Bank providing their personal information to the iPASS Corporation when issuing the card, in order to complete iPASS Card registration procedures and to provide cardholder services. Should any of the personal information provided by the cardholder change, the cardholder should immediately notify E.SUN Bank of such changes, in order for iPASS registration information to be updated.
II. Card instructions: (I) The features and usage methods of the iPASS Card shall be provided by the iPASS Corporation. iPASS Card balances may be spent through the methods and features provided in the iPASS Electronic Stored-Value Card Standard Agreement published by the iPASS Corporation, or through the methods and features announced on the iPASS website (www.i-pass.com.tw). (II) If the cardholder uses the Co-Branded Card as an iPASS Card before completing procedures for activating their credit card, they shall still be responsible for the autoload charges incurred for using the iPASS card. (III) Newly-issued iPASS Co-Branded Cards have their autoload function enabled by default, and are issued with a balance of zero. This also applies to iPASS Co-Branded Cards re-issued in the future, or issued as a replacement card. The cardholder is required to submit an application to E.SUN Bank should they wish to disable the autoload function. They may also do so by following the rules and instructions announced by the iPASS corporation. However, the autoload function may not be re-enabled once it has been disabled. The cardholder is required to apply for another iPASS Co-Branded Card from E.SUN Bank should they wish to resume using the iPASS and autoload function.
III. iPASS Co-Branded Card top-up methods and limits: The iPASS Card does not require a deposit, and may be repeatedly topped up and used. The maximum card balance is as announced on the iPASS Corporation website (the current limit is NT$10,000). The cardholder may top-up iPASS Card balances using the following methods: (I) Autoload: An iPASS Co-Branded Card with the autoload function enabled will automatically be topped up with the set autoload amount, or a multiple of this amount, from the cardholder's credit card through the connected autoload machine whenever the iPASS Card balance is insufficient to cover the current purchase, or whenever the card balance falls below a specific amount. Topping up card balances through autoload does not incur any service fees, and no receipt is generated. The autoload amount and limit shall be based on laws and regulations, and the rules established by the iPASS Corporation and E.SUN Bank. (II) Manual top-up: The cardholder may top-up iPASS Card balances with cash at iPASS Add-Value Machines (AVM) at locations designated by the iPASS Corporation, partnered organizations, public transport service locations, or other locations. Please refer to the information published on the iPASS Corporation website for more details on manual top-up locations and rules. (III) Other top-up methods: Please refer to the other methods provided in the iPASS Electronic Stored-Value Card Standard Agreement published by the iPASS Corporation, or information announced on the iPASS Corporation website.
IV. Card expiry: The expiration date of the iPASS card is the same as that of the credit card. When the credit card expires, the card’s iPASS and autoload functions shall also be terminated.
V. The iPASS card balance does not accrue interest, and cardholder rights and interests, the trust organization, and other related rights and interests are guaranteed by iPASS Corporation through a trust arrangement.
VI. The iPASS card balance may not be transferred. When the iPASS card is replaced/re-issued, the iPASS card balance can not be transferred into the new card, or another different card. The remaining iPASS card balance can only be credited to the cardholder’s credit card account, and used to offset the cardholder’s credit card bills.
VII. The cardholder may not alter or allow others to alter any part of the iPASS Co-Branded Card, including but not limited to removing the iPASS Co-Branded Card chip or antenna, or modify or tamper with the software or data stored inside the iPASS Co-Branded Card. E.SUN Bank and iPASS Corporation are entitled to claim compensation from the cardholder related to any costs, expenses, losses or damages to E.SUN Bank or iPASS Corporation that are attributable to the cardholder's violation of the above agreement terms and conditions.
VIII. If the iPASS Co-Branded Card cardholder fails to notify E.SUN Bank of any changes to the email, contact address or contact information specified in the application form, E.SUN Bank and the iPASS Corporation shall continue delivering future correspondence to the cardholder's last known address. Once E.SUN Bank or the iPASS Corporation has delivered business correspondence documents or required notifications to the cardholder's last known contact address or to the address specified in the application form, these documents and notifications shall be considered as legally received after the standard delivery time has elapsed.
Article 3 Applying for and using the iPASS Card
I. Application and use:
(I) The applicant shall truthfully fill out all parts of the iPASS Co-Branded Card application form, and immediately notify the issuing bank if any of the information filled in should change in the future.
(II) If the cardholder uses the Co-Branded Card as an iPASS Card before completing procedures for activating their credit card, they shall still be responsible for the autoload charges incurred for using the iPASS card.
(III) Newly-issued iPASS Co-Branded Cards have their autoload function enabled by default, and are issued with a balance of zero. This also applies to iPASS Co-Branded Cards re-issued in the future, or issued as a replacement card. The cardholder is required to submit an application to the issuing bank should they wish to disable the autoload function. They may also do so by following the rules and instructions announced by the iPASS Corporation. However, the autoload function may not be re-enabled once it has been disabled. The cardholder is required to apply for another iPASS Co-Branded Card from the issuing bank should they wish to resume using the iPASS and autoload function.
II. The usage methods and features of the iPASS Card shall be provided by the iPASS Corporation. iPASS Card balances may be spent through the methods and features provided in the iPASS Electronic Stored-Value Card Standard Agreement published by the iPASS Corporation, or through the methods and features announced on the iPASS Corporation website (web address: www.i-pass.com.tw)
Article 3 Misplacement, theft, damage, or loss of the iPASS Co-Branded Card
I. The iPASS Co-Branded Card and its embedded chip is the property of E.SUN Bank. The cardholder is responsible for maintaining proper custody of the card as a prudent administrator, and for preventing it from misplacement, theft, fraud, loss, or falling into the hands of any third party. The cardholder shall also avoid revealing card information to others.
II. If the iPASS Co-Branded Card has been misplaced, stolen or in any way lost (collectively referred to as "lost"), the cardholder must notify E.SUN Bank or its designated agents as quickly as possible to have the credit card suspended. Unless provided otherwise in the agreement, the cardholder shall pay E.SUN Bank a loss and replacement fee of NT$200. Please refer to E.SUN Bank’s credit card agreement for details on cardholders' rights and obligations in the event that the card is lost.
III. Should the iPASS balance of an iPASS Co-Branded Card suffer losses due to a payment or fraud within three hours before or after the card is reported as lost following the procedures described in the item above, these losses shall be borne by the cardholder. The card balance shall be transferred to the cardholder’s credit card account within approximately forty working days of the card being reported as lost. The amount transferred shall be based on the card balance recorded by the iPASS Corporation at three hours after the card is reported as lost, after deducting the amount autoloaded onto the card that E.SUN Bank is responsible for (these funds shall be returned to E.SUN Bank). However, if this remaining balance is negative, the cardholder shall agree to treat this negative balance as an ordinary purchase expense and have it collected from their credit card account.
IV. Any losses incurred by the cardholder due to autoload transactions that take place within three hours of the cardholder reporting the card as lost shall be handled pursuant to the credit card agreement. The iPASS Corporation shall be responsible for any losses arising from fraudulent autoload or iPASS transactions that take place three hours after the card has been reported as lost. These funds shall be refunded to the cardholder upon the next iPASS top-up.
Article 4 Card top-up and limits

IV. Purchases made with the iPASS Card at any associated merchant are subject to a limit of NT$1,000 per transaction and NT$3,000 per day. However, neither the single nor the daily transaction limit applies to payments for government collections, taxes, utility bills, tuition fees, medical spending, public transportation (including ferries and public bicycles), parking fees, or any other payments for public goods or services specially approved by the competent authorities.
V. The cardholder may not alter or allow others to alter any part of the iPASS Co-Branded Card, including but not limited to removing the iPASS Co-Branded Card chip or antenna, or modify or tamper with the software or data stored inside the iPASS Co-Branded Card.
The issuing bank and iPASS Corporation are entitled to claim compensation from the cardholder for any costs, expenses, losses, or damages to the issuing bank or iPASS Corporation that are attributable to the cardholder's violation of the above agreement terms and conditions.
VI. If the iPASS Co-Branded Card cardholder fails to notify the issuing bank of any changes to the email, contact address or contact information specified in the application form, the issuing bank and the iPASS Corporation shall continue delivering future correspondence to the cardholder's last known address. Once the issuing bank or the iPASS Corporation has delivered business correspondence documents or required notifications to the cardholder's last known contact address or to the address specified in the application form, these documents and notifications shall be considered as legally received after the standard delivery time has elapsed.
Article 4 Issue of replacement or new iPASS Co-Branded Cards in the event that the card has been lost, destroyed, or has expired
I. Following an application from the cardholder, E.SUN Bank shall issue a new iPASS Co-Branded Card with a balance of zero to the cardholder in the event that an iPASS Co-Branded Card has been lost. If the iPASS Co-Branded Card had been lost due to the fault of the iPASS Corporation or E.SUN Bank, the cardholder shall not be charged a replacement fee.
II. The cardholder may apply for a replacement card from E.SUN Bank should their iPASS Co-Branded Card become contaminated, had its chip degaussed, scratched, damaged, malfunction, or otherwise become unusable. The autoload and iPASS functions of the old card shall be terminated when this happens.
III. When the iPASS Co-branded Card expires, the card’s iPASS and autoload functions shall also be terminated. Unless any incident that would lead to the termination of the iPASS Co-branded Card agreement takes place, E.SUN Bank agrees to issue a new card with the same functions to the cardholder with an iPASS balance of zero when their existing card expires.
IV. The new replacement card shall have an iPASS balance of zero. The old card’s iPASS balance will be credited to the cardholder's credit card account within forty working days of the iPASS Corporation receiving the notification from E.SUN Bank. This credit can be used to offset the cardholder’s credit card bill. However, if the iPASS Card balance is negative, the cardholder shall agree to treat this negative balance as an ordinary purchase expense, and have it deducted from their credit card account.

Article 5 iPASS Card suspension and procedures for handling iPASS Card balance
Should the cardholder apply to suspend iPASS functions during the effective period of the iPASS Co-Branded Card, the cardholder may apply for their iPASS Card balance to be refunded through the methods described below. Once the card has been suspended and the balance returned, iPASS functions and the autoload function shall be terminated:
I. The cardholder may apply for a refund in person at a iPASS Corporation service location or some other location designated by the iPASS Corporation. They are required to bring along their iPASS Co-Branded Card and their personal ID documents. The iPASS balance will be refunded in cash, and the credit card functions of the card shall still remain effective.
II. The cardholder may submit an application to E.SUN Bank to suspend the iPASS Co-Branded Card and transfer the remaining card balance. The old card’s iPASS balance will be credited to the cardholder's credit card account within forty working days of the iPASS Corporation receiving the notification from E.SUN Bank. This credit can be used to offset the cardholder’s credit card bill. However, if the iPASS Card balance is negative, the cardholder shall agree to treat this negative balance as an ordinary purchase expense, and have it deducted from their credit card account.
Article 6 Issue of replacement or new cards in the event that the card has been lost, destroyed, or has expired
I. Should the cardholder lose the iPASS Co-Branded Card, the issuing bank may issue a new card with the same functionality but zero iPASS balance upon the cardholder's request.
II. The cardholder may apply for a new card should their iPASS Co-Branded Card become contaminated, had its chip degaussed, scratched, damaged, malfunction, or otherwise become unusable. The old card’s autoload and iPASS functions will then be disabled.
III. When the iPASS Co-branded Card expires, the card’s iPASS and autoload functions shall also be terminated.
IV. The re-issued or replacement card shall have an iPASS balance of zero. The old card’s iPASS balance will be credited to the cardholder's credit card account within 40 working days of receiving the notification from the issuing bank. This credit can be used to offset the cardholder’s credit card bill. However, if the iPASS card balance is negative, the cardholder shall agree to treat this negative balance as an ordinary purchase expense, and have it deducted from their credit card account.
Article 6 Procedures for transaction records and card balance queries
I. The cardholder may use an iPASS Card inquiry terminal or approach the customer service office of an MRT station to check the iPASS balance and see a record of the last six transactions. This information can also be looked up on the iPASS Corporation website (www.i-pass.com.tw). For any questions related to an iPASS Card transaction, please contact iPASS customer service at the telephone number: 07-791-2000.
II. E.SUN Bank shall display the iPASS Co-Branded Card autoload transaction dates and amounts on the cardholder’s credit card bill.
III. Should the cardholder have any queries regarding the above transaction history or balance, the cardholder may notify E.SUN Bank and request that the Bank verify if transactions are valid before the payment deadline for that period, providing E.SUN Bank with the required documents.
IV. For iPASS Card purchases where the deferred goods are not delivered or where the cardholder has a dispute regarding the services provided, the cardholder may appeal the purchase to iPASS Corporation if the dispute could not be resolved with the associated merchant. To do so, the cardholder is required to submit a proof of transaction (e.g. original purchase order for deferred goods or services, original invoice or other documents suffice to prove the transaction) and the card used for the purchase to iPASS Corporation. Once verified, the iPASS Corporation will refund the cardholder’s purchase.
Article 7 iPASS card suspension and procedures for handling iPASS card balance
Should the cardholder apply to suspend iPASS functions during the effective period of the iPASS Co-Branded Card, the cardholder may apply for their iPASS card balance to be refunded through the methods described below. Once the card has been suspended and the balance returned, the card’s iPASS and autoload functions shall be disabled, though the Co-Branded Card may still be used as a credit card:
I. The cardholder may apply for a refund in person at a iPASS Corporation customer service location or some other location designated by the iPASS Corporation. They are required to bring along their iPASS Co-Branded Card and their personal ID documents, and the iPASS balance will be refunded in cash.
II. The cardholder may submit an application to the issuing bank to suspend the iPASS Co-Branded Card and transfer the remaining card balance. The old card’s iPASS balance will be credited to the cardholder's credit card account within 40 working days of receiving the notification from the issuing bank. This credit can be used to offset the cardholder’s credit card bills. However, if the iPASS card balance is negative, the cardholder shall agree to treat this negative balance as an ordinary purchase expense, and have it deducted from their credit card account.
Article 7 Termination events
Should the cardholder engage in any of the following actions, or violate these Terms and Conditions, E.SUN Bank shall suspend or terminate the cardholder’s iPASS Card, and request that the iPASS Corporation carry out a balance transfer of the card balance to the cardholder’s credit card account. This balance can be used to offset the cardholder’s credit card bill. The iPASS Card’s autoload function shall also be terminated:
I. The cardholder engages in a purchase or transaction involving an illegal product or service using the iPASS Co-Branded Card at an iPASS associated merchant, or at a sales location specified by E.SUN Bank.
II. The cardholder conspires with a third party or an associated merchant to create fictitious transactions or commit fraud, or exchanges the card for cash, loans or any illegitimate gains.
III. The cardholder violates E.SUN Bank’s credit card agreement, or E.SUN Bank suspends or terminates the cardholder’s credit card access, either through directly terminating the credit card contract, or forcibly suspending the credit card.
Article 8 Procedures for transaction records and card balance queries
I. The cardholder may use a iPASS card inquiry terminal or approach the customer service office of an MRT station to check the iPASS balance and see a record of the last six transactions. This information can also be looked up on the iPASS Corporation website (www.i-pass.com.tw). For any questions related to an iPASS card transaction, please contact iPASS customer service at the telephone number: 07-791-2000.
II. The issuing bank should display the iPASS Co-Branded Card autoload transaction dates and amounts on the cardholder’s credit card bill.
III. Should the cardholder have any queries regarding the above transaction history or balance, the cardholder may notify the issuing bank and request that the issuing bank verify if transactions are valid before the payment deadline for that period, providing the issuing bank with the required documents.
IV. For iPASS Card purchases where the deferred goods are not delivered or where the cardholder has a dispute regarding the services provided, the cardholder may appeal the purchase to iPASS Corporation if the dispute could not be resolved with the associated merchant. To do so, the cardholder is required to submit a proof of transaction (e.g. original purchase order for deferred goods or services, original invoice or other documents suffice to prove the transaction) and the card used for the purchase to iPASS Corporation. Once verified, the iPASS Corporation will refund the cardholder’s purchase.
Article 8 Collection of fees
Any service fees or other charges that the cardholder is liable for pursuant to these Terms and Conditions shall be included on the cardholder’s credit card bill. The iPASS Card balance transferred by E.SUN Bank into the cardholder’s credit card account shall be first used to make payment for the cardholder’s credit card bill. Any funds leftover after the bill has been settled shall be handled pursuant to E.SUN Bank’s overpayment rules. However, should the cardholder independently submit a request to the iPASS Corporation to look up their transaction records, the iPASS Corporation shall collect a service fee from the cardholder, or deduct this service fee from their iPASS balance. Service fees shall be processed pursuant to the iPASS Electronic Stored-Value Card Standard Agreement published by the iPASS Corporation. The cardholder may use the automated service machines provided by the iPASS Corporation to check their past six transaction records and card balance for free.
Article 9 Termination events
The issuing bank may suspend or terminate the ability of the cardholder to use the iPASS card’s functions or the autoload function, if the cardholder is found to have violated these Terms and Conditions, or engages in any of the following actions:
I. The cardholder engages in a purchase or transaction involving an illegal product or service using the iPASS Co-Branded Card at an iPASS associated merchant, or at a sales location specified by the issuing bank.
II. The cardholder conspires with a third party or an associated merchant to create fictitious transactions or commit fraud, or exchanges the card for cash, loans or any illegitimate gains.
III. The cardholder violates the issuing bank’s credit card terms and conditions, or the issuing bank suspends or terminates the cardholder’s credit card access, either through directly terminating the credit card agreement, or forcibly suspending the credit card.
Article 9 Amendments to these Terms and Conditions and Miscellaneous Provisions
Other matters not described in these Special Terms and Conditions shall be governed by E.SUN Bank’s credit card agreement, the iPASS Electronic Stored-Value Card Standard Agreement published by the iPASS Corporation, or other announced rules.
Article 10 Collection of fees
Any account service fees, work fees, card suspension service fees, or other related charges that the cardholder is liable for under these Terms and Conditions shall be charged directly to the cardholder’s credit card. The iPASS Card balance transferred by the issuing bank into the cardholder’s credit card account shall be first used to offset the cardholder’s credit card bill. Any funds leftover after the bill has been settled shall be handled pursuant to the issuing bank’s overpayment rules. However, should the cardholder independently submit a request to the iPASS Corporation to look up their transaction records, the iPASS Corporation shall collect a service fee from the cardholder, or deduct this service fee from their iPASS balance. The service fee amount charged shall be based on the iPASS Corporation’s rules governing these services. The cardholder may use the automated service machines provided by the iPASS Corporation to check their past six transaction records and card balance for free.
Article 11 Amendments to these Terms and Conditions and Miscellaneous Provisions
Other matters not described in these Special Terms and Conditions shall be governed by the issuing bank’s credit card agreement, the iPASS Corporation Electronic Payment Institution Standard Services Agreement, or other announced rules.
