In conjunction with the rules of the iPASS Corporation, an adjustment has been made to the description for the autoload function of the iPASS Card. The iPASS Special Terms and Conditions have been amended, with the order of the original Articles being re-organized, and some provisions being amended. If you have any objections to these amendments, please notify E.SUN before the date that these amendments become effective to terminate your agreement. If you do not do so before this date, you shall be considered as having agreed to these amendments:

Article 2 Applying for and using the iPass card

The applicant shall truthfully fill out all parts of the application form and submit this application to E.SUN Bank to apply for an iPass Co-Branded Card pursuant to E.SUN Bank’s rules. The cardholder is required to agree to E.SUN Bank providing their personal information to the iPASS Corporation when issuing the card, in order to complete iPASS Card registration procedures and to provide cardholder services.Should any of the personal information provided on the application form change, the cardholder should immediately notify E.SUN Bank of such changes, in order for iPASS registration information to be updated.

Article 3 Applying for and using the iPass card
I. Application and use:
(I) The cardholder shall fill out all parts of the application form and submit this application to E.SUN Bank to apply for an iPass Co-Branded Card pursuant to E.SUN Bank’s rules. The cardholder is required to agree to E.SUN Bank providing their basic personal information to the iPASS Corporation when issuing the card, in order to complete iPASS Card registration procedures and to provide cardholder services. Should any of the personal information provided change, the cardholder should immediately notify E.SUN Bank of such changes pursuant to E.SUN Bank's rules, in order for iPASS registration information to be updated.

(III) Newly-issued iPASS Co-Branded Cards have their autoload function enabled by default, and are issued with a balance of zero. This also applies to iPASS Co-Branded Cards re-issued in the future, or issued as a replacement card. The cardholder is required to submit an application to E.SUN Bank should they wish to disable the autoload function. They may also do so by following the rules and instructions announced by the iPASS corporation. However, the autoload function may not be re-enabled once it has been disabled. (IV) The cardholder agrees that E.SUN Bank may provide the iPASS Corporation with personal information such as their name, National ID number (or passport number), date of birth, phone number, and address in order for the iPASS Card to be approved and issued. The cardholder also agrees that the iPASS Corporation may use this personal information to facilitate the specific functions of the iPASS Co-Branded Card and to provide card-related services (such as registering a card as lost). The cardholder is entitled to exercise their rights pursuant to Article 3 of the Personal Data Protection Act. If the cardholder does not agree to allow the iPASS Corporation to use their personal information, the iPASS Co-Branded Card cannot be approved and issued, due to iPASS functions not being able to function correctly. | |
III. iPASS Co-Branded Card top-up and limits
The iPASS Card does not require a deposit, and may be repeatedly topped up and used. The maximum card balance is as announced on the iPASS Corporation website (the current limit is NT$10,000). The cardholder may top-up iPASS Card balances using the following methods:
(I) Autoload: An iPASS Co-Branded Card with the autoload function enabled will automatically be topped up with the set autoload amount, or a multiple of this amount, from the cardholder's credit card through the connected autoload machine whenever the iPASS Card balance is insufficient to cover the current purchase, or whenever the card balance falls below a specific amount. Topping up card balances through autoload does not incur any service fees, and no receipt is generated. The autoload amount and limit shall be based on laws and regulations, and the rules established by the iPASS Corporation and E.SUN Bank.

Article 4 iPASS Card top-up and limits
The iPASS Card may be repeatedly topped up and used. The maximum card balance is as announced on the iPASS Corporation website (the current limit is NT$10,000). The cardholder may top-up iPASS Card balances using the following methods:
Autoload: An iPASS Card will automatically be topped up with NT$200, or a multiple of this amount, from the cardholder's credit card through the connected autoload machine whenever the iPASS Card balance is insufficient to cover the current purchase, or whenever the card balance falls below a specific amount. Topping up card balances through autoload does not incur any service fees, and no receipt is generated. The autoload amount and limit shall be based on laws and regulations, and the rules established by the iPASS Corporation and E.SUN Bank. Refer to the iPASS Corporation website for a definitive explanation of how the autoload system works. Based on the current rules set by iPASS Corporation, the daily autoload limit is NT$1,000, including for autoload top-ups triggered at an MRT or TRA turnstile. Top-up machines not limited by this daily iPASS Co-Branded Card autoload limit include: Add-Value Machines (AVM) and iPASS machines installed by some designated organizations.

(II) Manual top-up: The cardholder may top-up iPASS Card balances with cash at iPASS Add-Value Machines (AVM) at locations designated by the iPASS Corporation, partnered organizations, public transport service locations, or other locations. Please refer to the information published on the iPASS Corporation website for more details on manual top-up locations and rules. | II. V. The iPASS Card balance does not accrue interest, and cardholder rights and interests, the trust organization, and other related rights and interests are guaranteed by iPASS Corporation through a trust arrangement. |
Article 4
IV. The iPASS balance does not accrue interest. Apart from the reserve amount deposited pursuant to Article 18 of the Act Governing Issuance of Electronic Stored Value Cards, the remainder of the funds deposited into iPASS balances by cardholders has been handed over by the iPASS Corporation into a trust. Pursuant to Article 18, Paragraph 2 of the Act Governing Issuance of Electronic Stored Value Cards, when the iPASS Corporation hands over deposited iPASS balance into a trust under the custody of a trust organization, the beneficiary of the trust shall be the iPASS Corporation, and not the cardholders. As the trust organization is managing and disposing of trust assets on behalf of iPASS Corporation and not the cardholders, the cardholder may only request that the issuing organization or the trust organization provide a copy of the trust agreement. A cardholder shall have priority over other creditors and shareholders of the issuing organization for repayment of debt incurred by the iPASS service with respect to the trust assets under the custody of the trust organization described in the above paragraph.

VI. Non-transferability of iPASS Card balance: When the iPASS Card is replaced/re-issued, the iPASS Card balance can not be transferred into the new card, or another different card. The remaining iPASS Card balance can only be credited to the cardholder’s credit card account, and used to offset the cardholder’s credit card bills. |

E.SUN Bank and iPASS Corporation are entitled to claim compensation from the cardholder related to any costs, expenses, losses or damages to E.SUN Bank or iPASS Corporation that are attributable to the cardholder's violation of the above agreement terms and conditions. |

VIII. If the iPASS Co-Branded Card cardholder fails to notify E.SUN Bank of any changes to the email, contact address or contact information specified in the application form, E.SUN Bank and the iPASS Corporation shall continue delivering future correspondence to the cardholder's last known address. Once E.SUN Bank or the iPASS Corporation has delivered business correspondence documents or required notifications to the cardholder's last known contact address or to the address specified in the application form, these documents and notifications shall be considered as legally received after the standard delivery time has elapsed. |
Article 3
IV. If the iPASS Co-Branded Card holder fails to notify E.SUN Bank of any changes to the contact address or contact information specified in the application form, E.SUN Bank and the iPASS Corporation shall continue delivering future correspondence to the cardholder's last known contact address, or the address specified on the application form. Once E.SUN Bank or iPASS Corporation have sent their business correspondence or required notifications to the cardholder's last known contact address or to the address specified in the application form, they will be deemed as duly received after the usual time of delivery has elapsed.

Article 3 Misplacement, theft, damage, or loss of the iPASS Co-Branded Card

If the iPASS Co-Branded Card has been misplaced, stolen or in any way lost (collectively referred to as "lost"), the cardholder must notify E.SUN Bank or its designated agents as quickly as possible to have the credit card suspended. Unless provided otherwise in the agreement, the cardholder shall pay E.SUN Bank a loss and replacement fee of NT$200. Please refer to E.SUN Bank’s credit card terms and conditions for details on cardholders' rights and obligations in the event that the card is lost. E.SUN Bank shall notify iPASS Corporation to also register the iPASS Card as lost.

Article 5 Misplacement, theft, damage, or loss of the iPASS Co-Branded Card
II. If the iPASS Co-Branded Card has been misplaced, stolen or in any way lost (collectively referred to as "lost"), the cardholder must notify E.SUN Bank or its designated agents as quickly as possible to have the credit card suspended. Unless provided otherwise in the agreement, the cardholder shall pay E.SUN Bank a loss and replacement fee of NT$200. Please refer to E.SUN Bank’s credit card terms and conditions for details on cardholders' rights and obligations in the event that the card is lost. E.SUN Bank shall notify iPASS Corporation to also register the iPASS Card as lost. Should E.SUN Bank or the iPASS Corporation deem it necessary, they shall notify the cardholder within ten days of the latter reporting loss of the iPASS Co-Branded Card that the cardholder is required to file a report with the local police authorities, or submit a supplementary written notice to E.SUN Bank or iPASS Corporation within three days of receiving the notice. Should the cardholder fail to furnish the documents requested by E.SUN Bank or the iPASS Corporation after reporting a card as lost, refuse to assist in an investigation, fail to file a police report, or otherwise fails to act in good faith, they shall be held solely liable for all losses arising from their iPASS Co-Branded Card being misused by others.

Article 4 Issue of replacement or new iPASS Co-Branded Cards in the event that the card has been lost, destroyed, or has expired
I. Following an application from the cardholder, E.SUN Bank shall issue a new iPASS Co-Branded Card with a balance of zero to the cardholder in the event that an iPASS Co-Branded Card has been lost. If the iPASS Co-Branded Card had been lost due to the fault of the iPASS Corporation or E.SUN Bank, the cardholder shall not be charged a replacement fee.

Article 6 Issue of replacement or new iPASS Co-Branded Cards in the event that the card has been lost, destroyed, or has expired
I. Following an application from the cardholder to re-issue a card after their original card has been reported lost, E.SUN Bank shall issue a new iPASS Co-Branded Card with a balance of zero to the cardholder in the event that an iPASS Co-Branded Card has been lost. If the iPASS Co-Branded Card had been lost due to the fault of the iPASS Corporation or E.SUN Bank, the cardholder shall not be charged a replacement fee.

The iPASS Co-Branded Card has the same functions as an iPASS Standard Card, and cardholders may enjoy the same iPASS discounts offered by iPASS Corporation to iPASS Standard Card cardholders. Any changes to these discounts shall be handled pursuant to iPASS Corporation rules.

Article 8 Collection of fees
Any service fees or other charges that the cardholder is liable for pursuant to these Special Terms and Conditions shall be included on the cardholder’s credit card bill. The iPASS Card balance transferred by E.SUN Bank into the cardholder’s credit card account shall be first used to make payment for the cardholder’s credit card bill. Any funds leftover after the bill has been settled shall be handled pursuant to E.SUN Bank’s overpayment rules. However, should the cardholder independently submit a request to the iPASS Corporation to look up their transaction records, the iPASS Corporation shall collect a service fee from the cardholder, or deduct this service fee from their iPASS balance. Service fees shall be processed pursuant to the iPASS Electronic Stored-Value Card Standard Agreement published by the iPASS Corporation. The cardholder may use the automated service machines provided by the iPASS Corporation to check their past six transaction records and card balance for free.

Article 11 Collection of fees
Any service fees or other charges that the cardholder is liable for pursuant to these Special Terms and Conditions shall be included on the cardholder’s credit card bill. The iPASS Card balance transferred by E.SUN Bank into the cardholder’s credit card account shall be first used to make payment for the cardholder’s credit card bill. Any funds leftover after the bill has been settled shall be handled pursuant to E.SUN Bank’s overpayment rules. However, charges for the following services provided by iPASS Corporation at the cardholder's request shall be separately collected by iPASS Corporation from the cardholder, or directly deducted from the cardholder's iPASS balance: I. Transaction inquiry charges: The cardholder may look up their card balance and a record of their last six iPASS transactions for free using the automated service machines provided by iPASS Corporation, and the cardholder may also request iPASS Corporation provide a paper document listing their full transaction details for the past 5 years, subject to a fee of NT$20 for the first page and NT$5 for every following page. (Example #1: Cardholder requests their iPASS transaction history in writing for the period from August 1 to August 5. After being printed out, these transaction details were one page in length, and the cardholder was charged NT$20. Example #2: Cardholder requests their iPASS transaction history in writing for the period from August 1 to December 25. After being printed out, these transaction details were three pages in length, and the cardholder was charged NT$20 for the first page, NT$5 for the second page, and NT$5 for the third pages, resulting in a total charge of NT$30.
